Massachusetts Attorney-Closing Requirement
Massachusetts is one of approximately 22 attorney-closing states in the country โ and it enforces the requirement more strictly than most. Every mortgage closing and every conveyance of title to real estate must be conducted by a Massachusetts-licensed attorney. This is not a recommendation or a best practice. It is the law.

Which Mortgage Documents Require Notarization
A typical Massachusetts residential mortgage closing package runs 100โ200 pages. Most pages require only a signature. A smaller but legally critical subset requires full notarization โ a correctly completed acknowledgment certificate, official seal, and commission expiration date โ to be valid for recording at the Registry of Deeds.
Under the Massachusetts Registers and Assistant Registers of Deeds Association Index Standards (revised January 2025), any instrument offered for recording must include at least one acknowledgment. A missing or defective acknowledgment on the mortgage itself is grounds for rejection at the Registry, which prevents funding until re-execution is completed.

Right of Rescission โ The 3-Business-Day Rule
The federal Truth in Lending Act (TILA, 15 U.S.C. ยง1635) gives a borrower the right to cancel a refinance of their primary residence within 3 business days of signing. This rule does not apply to purchase transactions or to investment properties. It is the single most important timing constraint in a refinance closing, and a dating error on the rescission notice can delay funding by days.
Business days under TILA include every day except Sundays and federal public holidays. The day of signing is Day Zero โ it does not count. The 3-day window begins the morning after signing.
At the signing appointment, the notary signing agent confirms that the borrower receives two copies of the right-of-rescission notice, that the date on the notice matches the actual signing date, and that the borrower understands the window. The agent does not advise on whether to exercise the right โ that is a legal question for the closing attorney or the borrower’s own counsel.

Five Errors That Delay Massachusetts Mortgage Closings
After 1,190+ signings, these are the most common defects we see that delay loan funding or require re-execution:
1. Jurat on a Pre-Signed Document
The affidavit of title requires a jurat โ the borrower must sign in the notary’s presence and take an oath. A borrower who signed it at the kitchen table before the notary arrived has created a defective notarization. The document must be executed again with a fresh signature in the notary’s presence. This happens most often when the closing package is emailed to the borrower in advance.
2. Missing or Incomplete Acknowledgment Certificate
The Massachusetts Registry of Deeds (Index Standards, January 2025) rejects instruments with missing seals, blank commission-expiration dates, or incomplete identification fields. The notary must complete every field of the acknowledgment certificate โ date, signer name, evidence of ID, signature, seal, and expiration. A missing field means rejection at the Registry and delayed recording.
3. Right-of-Rescission Date Error
The most common timing error: the rescission notice is dated the day before the signing actually occurred, the agent counts the signing day as Day 1, or a Saturday signing miscounts Sunday as a business day. Any of these means the loan cannot fund on the scheduled date. The correct date is confirmed before we leave for every refinance appointment.
4. Wrong ID Presented
An expired driver’s license, a Social Security card, or a foreign ID not recognized under Massachusetts notary standards. The notary must decline to proceed until valid, unexpired government-issued photo ID is presented. 5. Missing Trustee Certificate or Incorrect Capacity Acknowledgment
When property is held in a Massachusetts nominee trust, the signing agent needs a properly executed trustee certificate and must use a representative-capacity acknowledgment.
