What Is an Affidavit and
Why Does It Need a Notary?
An affidavit is a written statement made under oath. The person making the statement — called the affiant — swears or affirms before a notary public that the facts in the document are true. Lying in an affidavit constitutes perjury under Massachusetts law — a serious criminal offense.
The notarization used for affidavits in Massachusetts is called a jurat (also called an oath or affirmation). Unlike an acknowledgment — which only confirms identity and voluntary signing — a jurat requires the notary to administer a verbal oath before the document is signed. This is a meaningful legal distinction that many signers and even some notaries misunderstand.
Massachusetts law under M.G.L. c.222 requires the affiant to appear in person before the notary. Remote online notarization is not permitted for standard affidavits in Massachusetts. The notary must verify your identity, administer the oath, witness your signature, and complete a jurat certificate.
Your affidavit must be signed in the physical presence of the notary after taking the oath — not before. A document signed before the appointment cannot be properly notarized. If you have already signed, reprint the document and sign again at the appointment.
A sworn statement operates on the same principle as an affidavit. Many courts, government agencies, financial institutions, and immigration authorities require sworn statements to be notarized with a jurat for full legal acceptance.

Affidavits Require a Jurat
These are two different Massachusetts notarial acts. Using the wrong one can invalidate your document. Affidavits and sworn statements always require a jurat — not an acknowledgment.

The name on your ID must exactly match the name on the affidavit. If there is a discrepancy — even a middle initial — bring a secondary ID to support it or have the affidavit corrected before the appointment.

What is the difference between an affidavit and a sworn statement?
An affidavit is a formal written statement made under oath before a notary. The notary completes a jurat certificate confirming the oath was administered and the signing was witnessed. A sworn statement is a broader term for any declaration made under oath — when institutions require it to be notarized, the same jurat process applies.

Does a notary administer an oath for an affidavit?
Yes. Affidavits require a jurat — the notary must verbally administer an oath or affirmation before you sign. You swear or affirm that the contents are true. This is different from an acknowledgment, which does not require an oath. Using an acknowledgment on an affidavit can invalidate the document.

Yes. Hanson Webb and Nora are fully fluent in Arabic. Hanson is also fluent in French. Affidavits in Arabic or French can be notarized without an interpreter — the notary reads and comprehends the document being sworn to. The jurat certificate is completed in English as required by Massachusetts law.
