Under M.G.L. c.222 §15(d), a signature witnessing is a notarial act where the notary watches you sign the document, verifies your identity through satisfactory evidence, and certifies that your signature was affixed in their presence. Can I sign the document before arriving?+
No — and this is the most common mistake. A signature witnessing requires you to sign in the notary’s presence. If you pre-sign, the notary can only perform an acknowledgment (where you acknowledge a prior signature), not a witnessing. Many documents — especially DS-3053 and healthcare proxies — explicitly require a witnessed signature, not an acknowledgment. Always arrive with your document unsigned.

What is the difference between a signature witnessing and an acknowledgment?+
A signature witnessing (§15(d)) requires you to sign in front of the notary. An acknowledgment (§15(a)) allows you to have already signed and then appear before the notary to acknowledge the prior signature was yours. Real estate deeds in Massachusetts typically use acknowledgments. DS-3053, healthcare proxies, and many government forms require witnessed signatures. If your document says “sign in the presence of a notary,” you need a signature witnessing.

How quickly can you notarize DS-3053 for a child’s passport?+

What ID is required for a signature witnessing?+
You must present valid, unexpired government-issued photo ID — a Massachusetts driver’s license, state ID, U.S. passport or passport card, military ID, or permanent resident card. The name on your ID must match the name on the document. Expired IDs are not accepted under M.G.L. c.222. Foreign driver’s licenses are generally not acceptable as standalone satisfactory evidence of identity in Massachusetts.
